Court decides to hear AS Kalev’s complaint



With the ruling of the Tallinn Administrative Court, received by AS Kalev  

22 November 2005, the court accepted AS Kalev’s claim for annulment of 

the resolution of the Northern Tax Centre of the Tax and Customs Board (TCB) 

dated 17 June 2005, or declaration of the nullity of the resolution. The 

court also ruled that AS Kalev’s application for initial legal protection 

was justified, and satisfied the application. With its ruling, the court 

suspended validity of the resolution of the TCB Northern Tax Centre until 

entry into force of the court verdict. The parties to the proceeding will 

be separately notified of the time of the court hearing.



On 15 July 2005, AS Kalev filed a claim with the Tallinn Administrative Court, 

demanding annulment of the resolution of the TCB Northern Tax Centre dated 

17 June 2005 on the declaration of carryover stock and excessive stock of sugar. 

AS Kalev believes that the company’s sugar stock declaration is correct, 

and that AS Kalev was not, as of 1 May 2004, an owner or possessor of the 

15.6-thousand-ton sugar stock declared excessive by the TCB.
