SUBMISSION OF COMPLAINT

 

Further to the 28 June 2005 stock exchange release entitled “AS Kalev disputes 

Tax and Customs Board decision,” the company hereby announces that it submitted 

a complaint to the Tallinn Administrative Court on Friday, 15 July, in which 

it asks that the decision of the Tax and Customs Board’s (TCB) Põhja tax 

centre of 17 June 2005 regarding determination of carry-over stock and 

overstock be annulled, to establish the mentioned decision as void and to 

not enforce the Surplus Quantities Fees Act with regard to the company 

because it is unconstitutional. AS Kalev continues to be of the position that 

it declared its sugar stock correctly and that the company was, as of 1 May 2004, 

not the owner or possessor of the warehouse stock of 15,600 tons determined by 

the TCB to be a surplus. The court dates will be set after the complaint is 

taken into proceedings by the administrative court.
