SUSPENSION OF TAX BOARD'S PRESCRIPTION



Based on Tallinn Administrative Court judge's decree of 04.12.2000, 

the Administrative Court suspended the execution of prescription made 

on 27.10.2000 by tax board to AS XXL.EE, until the court decision in 

the civil case filed on 29.11.2000 by AS XXL.EE against tax board 

takes effect. AS XXL.EE finds that the prescription, whereby XXL.EE 

is obliged to pay EEK 2,409,358 of value-added tax and EEK 764,220 

interest, is groundless and unlawful.



The claim is related with the alleged tax evasion under the former 

management of AS XXL.EE in 1998, when the company was still operating 

under Pennu Computer Technology Group business name. On 15.09.1999 

criminal suit was filed against the former export manager of Pennu 

Computer Technology Group in the same case, where AS XXL.EE was civil 

defendant. However, on 04.04.2000 additional investigation was 

started as no evidence was found against him. AS XXL.EE is the civil 

defendant in the criminal case. No evidence has been presented to 

connect AS XXL.EE with the alleged tax evasion.
