ASA KINDLUSTUS AS FILED AN APPLICATION AGAINST ELLEN RIDASTE

 

ASA Kindlustus AS filed an application to the Tallinn City 

Court against the Insurance Inspectorate and its Chief Executive 

Officer Ellen Ridaste, demanding cessation of insulting public 

statements and compensation for financial losses resulting from 

the above in the amount of 499 960 EEK.

 

In accordance with the application, the Chief Executive of the 

Insurance Inspectorate Ellen Ridaste has repeatedly made public 

statements in the Estonian media presenting information and opinions 

that go beyond her competence and are not accurate. The nature of 

such statements have been insulting towards ASA Kindlustus and 

resulted in significant financial losses for the company. 

 

ASA Kindlustus finds that the Republic of Estonia (through Ellen 

Ridaste, the head of Insurance Inspectorate as public institution) 

is responsible for losses proceeding from such insulting statements. 

When Ellen Ridaste made media statements, the nature of which was 

insulting towards ASA Kindlustuse AS, she thus represented the 

Republic of Estonia as the head of Insurance Inspectorate. Proceeding 

from the principles of the state based on the rule of law, the public 

administrator (i.e. the state) is in civil order responsible for 

losses caused by every person, provided that this person executes 

the tasks assigned to the public administrator. Neither the state nor 

its representatives are authorized to publish insulting information 

and opinions, as the legislation provides no such means of sanctioning.

 

In accordance with the application, ASA Kindlustuse AS has suffered 

losses in the form of unearned insurance premium revenues due to 

pre-maturely terminated insurance contracts, resulting from public 

statements made by the head of Insurance Inspectorate. 

 

In addition to the civil application filed to the Tallinn City Court, 

ASA Kindlustus AS also intends to file a criminal application against 

Ellen Ridaste.
