Suspending construction works of the new school building in Viimsi 



On April 19 2005, AS Merko Ehitus concluded a contract with SEB Ühisliising

AS for constructing a new school building complex in Viimsi. 



Tallinn Circuit Court decided to accept the initial legal protection appeal

addressed to the Court by AS Esmar and issued the respective regulation on

August 17 2005 thus suspending the building permit No 3261 issued on

September 13 2004 on account of regulation No 591 issued by Viimsi Rural

Municipility Government on September 10 2004 until the respective court

judgement enters into force. The following court session is scheduled on

September 1 2005.



Respective protection works are currently under way on the building site

in order to fulfil the court judgement and secure constructions’ safety and

weatherability during the suspension period. 



Suspending of the construction works has jeopardized timely completion of

the school building by the beginning of the term commencing on September 1,

2006. According to the concluded contracts, risks related to the validity

of the building permit as well additional costs arising from suspension of

the building permit are covered by the customer and Viimsi municipality.
